The key here is what the instruction meant by requiring "participation and combined action." If it requires that all the steps of the invention be performed together under the direction of one party, even if by different parties, it is unexceptional. If it goes further, and allows sequential steps by parties not under common direction and control, it is a dangerous expansion of the law, and one done in passing.
